First let me say this question is NOT ABOUT THE FACTS of whether or not Obama’s birth certificate is legitimate or not.
Just for the sake of argument though, let’s say you could prove that he wasn’t a natural born citizen. Then what do you expect would happen?
A. We’d do the election process all over again, possibly with different candidates.
B. Joe Biden would become president (since he won the VP slot).
C. John McCain would become president (since he finished second place for president)?

I’m really not sure about the legal standing there if that indeed happened, but it would be imperative that Obama step down to avoid a constitutional crisis. That said, its doubtful that much will become of Berg’s case, but who knows
The reason I am unsure about ‘B’ is due to the fact that Obama is not yet president, nor has the electoral college voted yet

Whatever the constitution says should happen. If Obama is NOT a natural born citizen of the States, then he should NOT be President. Simple. If the constitution says Biden becomes President, then he should be the President, which I think would happen before we have an election over. C isn’t provided for so it wouldn’t happen.
Don’t you find it interesting that some liberals refuse to have it discussed?

Biden would become president, as the president is now unable to serve (or an amendment would be passed immediately revoking the one that said that he could not be president).
That is all hypothetical, but McCain would not be president. All the issue was trying to prevent Obama from winning by disqualifying him before the vote.
Although, there would be so.many.lawyers that it would take years to figure it all out.

According to an interview I saw last night on television, if Obama were disqualified from holding the office; then the election would go to McCain/Palin, as they were the “runners up”.
Sort of like when Miss America is stripped of her crown, the title goes to the first runner up, I guess.

Enforcing the Constitution, and Frankly, that is all that matters… for us to remain the United States, the Constitution MUST be, and will be, enforced, and followed.
20th Amendment
Section 3.
If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.
That is what we hope to accomplish, and it’s not just Repubs, and Independents, it’s Dem’s as well, as a fact, BIDEN’S team first investigated it, and found the errors, and now.. you know, Biden just may be the smartest out of all of them, he is playing his cards very well.
It isn’t just about Berg’s Lawsuit, there are also suits in justt about every State.. and they are important, but also, Congress, who counts the Electoral Votes, and determines Eligibility on the 6th of January, plays a very important role.
Plus, the Electors have standing, and I know at least one who is involved in it now, and Berg’s law suit has only been dismissed previously due to standing, NOT Merit…. it’s simply not over.

The birth certificate argument allows the right to appease its fascist roots by attempting to overthrow the legitimately elected government through legalistic manoeuvres. Why should that surprise anybody, since that was what the Jennifer Flowers hearings were all about the last time a democrat sat in the Oval office.
Some of the conspirators have since admitted that Newt Gingrich and Tom Delay knew the Flowers accusations were without merit, but they also knew about Monica Lewinsky and needed the hearings to get Bill Clinton to claim he had never committed adultery. It was all about creating an impeachable offense.
You know, entrapment.
President Obama can be attacked by making a foreigner of him. That’s what they will do in an effort to keep him so busy defending himself that he will not be able to accomplish his agenda. They will start there and make it up as they go along.

Let’s ignore the b.s. on this and go through the law.
First, contrary to popular belief, people do not vote for the President. They vote for electors. Even if, between now and the electors voting in mid-December, Senator Obama was disqualified, those 365 Democratic electors would still be the electors since they won the election in their states They would then be free to vote for whomever they saw fit — probably Clinton or Biden.
Second, if you get past the counting of the electoral votes in early January, the law is equally clear. If the President-elect is not eligible or is unable to serve, the vice-president-elect becomes President. (Twentieth Amendment, Section 3).
It is a little less clear if something were to happen between the electors voting in December and their votes being counted in January. There is no Constitutional requirement that electors vote for an eligible person. There are constitutional requirements for the office of President but not for being a candidate or receiving votes. (Check out the language on electors in Article II and the Twelfth Amendment, the only restriction on their vote is that not more than one person can be from the same state.)
Most importantly, there is no way that the Berg suit is being resolved before January. Berg has filed, as is his right, a writ of certiorari. The Supreme Court is following its normal schedule giving the respondents the normal time to file a response to that request. On the normal calendar, the Court will decide whether or not to hear the case on January 9th (after the votes have been counted by Congress). If they grant certiorari, the case would be heard in April or May with a decision in June. The Supreme Court has rejected a request from Berg for a preliminary injunction pending the decision, so normal legislative procedures will go forward until there is a decision. In other words, the electors will vote for Obama-Biden in December and their votes will be counted in January.

Up until the Electoral College votes, nothing is set in stone. “If” something were to come to light that disqualified Obama, his Electors could vote for someone else. If they still voted for Obama then I believe it would fall to Congress to disqualify him at which point Biden would become President. As far as I know it’s the same situation as if the President Elect were to die before the inauguration.
But this is all just an academic exercise. There is absolutely nothing to show Obama is anything other than a natural born citizen of the United States.

According to the Constitution, Joe Biden would act as President until another one has been decided upon. Congress would have the power to decide how to elect a new one. Amendment XX to the Constitution reads as follows:
“…..If the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.
